There are three categories of child support in Texas:

  • Cash support: monthly payments made to one parent for the general expenses of looking after each child. You can agree to no child support if it is in the best interest of each child.
  • Medical support:  One parent is assigned as the payer of the monthly premium. Uninsured expenses, that are not taken care of by the policy, can be the responsibility of both parents.
  • Dental support: One parent is assigned as the payer of the monthly premium. Uninsured expenses, that are not taken care of by the policy, can be the responsibility of both parents.

Texas law requires that your court order include a provision for both medical and dental coverage for each child.

Texas uses guidelines based on the non-custodial parent’s net income (or “take-home” pay), the number of children, and certain other factors. The standard percentage ranges from 20% of net income for one child, up to 40% of net income for five or more children.

In an uncontested SAPCR, you can agree to an amount higher or lower than the guidelines or even agree to no child support at all, so long as you both deem it in the best interests of each child.
