If you and your spouse can agree to all the major terms of your divorce, then an Uncontested Divorce may be right for you.

An Uncontested Divorce is probably not right for you if:

  • have a poor understanding of each other’s assets and debts,
  • have difficulty agreeing upon child custody or child support arrangements, or
  • cannot agree on how to split assets and debts acquired during the marriage.

This service has been designed to accommodate a wide array of circumstances. However, if you or your spouse meet any of the following conditions, then you should not start the Uncontested Divorce process:

  • are under the age of 18,
  • are pregnant or expecting a child,
  • have an open bankruptcy,
  • wish to have sole custody,
  • have custody of another person’s child (inc. grandchildren),
  • have complex financial arrangements, or
  • do not have a clear understanding of one another’s assets or debts.

In Texas, when a divorce is finalized, the Decree of Divorce (“Decree”) that includes the division of marital assets and debts becomes part of the public record, which means it is accessible to anyone.

If you want to keep the details of your assets and debts completely off the public record, we can prepare a separate document called an Agreement Incident to Divorce (“Agreement”).

Under this approach:

  • A simplified Decree, which does not list the marital assets or debts but refers to your Agreement, is submitted to the court for the judge’s signature.
  • The detailed Agreement is signed by you and your spouse and kept private, away from the court, and off the public record.


Please note: We charge an additional $1,000 for up to two (2) hours of legal services to prepare the Agreement.

– If you or your spouse had a child with a third party during the marriage, then the appropriate acknowledgment of paternity and denial of paternity forms will need to be completed and filed with the court before the final hearing.
– The Firm can not offer Uncontested Divorce services if you or your spouse currently shares custody of one or more children with a third party, including grandchildren.
